3. Filing a DMCA Notice

If you are a copyright owner (or authorized to act on behalf of one) and believe that content available on PayUnlock.me infringes your copyright, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing:

Required Information:

1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
2. Identification of the infringing material: Identification of the material that is claimed to be infringing, including its location on our platform (URL or link ID). Please provide sufficient information to permit us to locate the material.
3. Your contact information: Your address, telephone number, and email address.
4. Statement of good faith belief: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
5. Statement of accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
6. Physical or electronic signature: Your physical or electronic signature.

4. How to Submit a DMCA Notice

Please send your DMCA notice to our Designated Copyright Agent:

Important: Please mark all correspondence clearly as a "DMCA Takedown Notice" to ensure prompt processing.

5. Our Response Process

Upon receipt of a valid DMCA notice, we will:

1. Acknowledge receipt of your notice within 24-48 hours
2. Review the notice for completeness and validity
3. Remove or disable access to the allegedly infringing content
4. Notify the content uploader of the removal
5. Provide the uploader with a copy of the DMCA notice
6. Take appropriate action against repeat infringers

Please note that we typically remove content within 1-3 business days of receiving a valid DMCA notice.

6. Counter-Notification

If you believe that your content was removed by mistake or misidentification, you may send a counter-notification to our Copyright Agent with the following information:

Required Information for Counter-Notice:

1. Your physical or electronic signature
2. Identification of the material that has been removed and the location where it appeared before removal
3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
4. Your name, address, telephone number, and email address
5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Barcelona, Spain if outside the United States), and that you will accept service of process from the person who provided the original DMCA notice

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed content.

7. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, PayUnlock.me has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.

We may also limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Our Actions Against Repeat Infringers:

• First Offense: Warning and content removal
• Second Offense: Temporary account suspension (7-30 days)
• Third Offense: Permanent account termination and forfeiture of pending payouts

8. False Claims

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

Filing a false DMCA notice can have legal consequences, including liability for damages, court costs, and attorneys' fees. Do not make false claims.

9. User Responsibility

As a content creator on PayUnlock.me, you are responsible for:

• Ensuring you have the right to upload and sell all content
• Not uploading copyrighted material without proper authorization
• Obtaining necessary licenses, permissions, or releases
• Understanding that copyright infringement can result in legal action against you
• Responding promptly to any DMCA notices you receive

10. Processing Time

We strive to process DMCA notices as quickly as possible:

• Acknowledgment: Within 24-48 hours
• Content Removal: Within 1-3 business days
• Counter-Notice Review: Within 5-7 business days
• Content Restoration: 10-14 days after counter-notice (if no legal action filed)
